New rules governing speed cameras, their placement and use, contained in the Infrastructure/Interior Ministerial Decree published in the Official Gazette on May 28, come into force.
The summer exodus, with particularly heavy traffic, will be the test by which the May ministerial decree will be put to the test. July and August are the months, Istat statistics say, when road fatalities increase, and speed control is important because it is one of the main causes of road accidents.

Fixed systems, which were already installed before the decree came into force, will be allowed to remain on for one year, while the regulations apply immediately to mobile stations. Fundamental then are the warning signs. Mario Rossi of Quattroruote explains, “The principle of transparency was introduced by the legislature to consolidate a relationship of loyalty between institutions and citizens. I tell you that there is speed control because my purpose is not to give you a ticket, but to make you respect the highway code.”
The knot of homologation remains unresolved: a recent cassation ruling stated that the devices must be homologized, but there is no procedure of homologation rules so, continues Mario Rossi of the specialized magazine Quattroruote, “at the moment no device can be tested, and it could open the door to possible appeals.”

What’s new

Electronic eyes will have to be clearly visible at all times, spaced out, and in the case of mobile devices, the challenge will have to be immediate. Sections of road on which speed cameras may be used will have to be identified by prefectorial order and marked at least 1 kilometer in advance outside built-up areas.
Also set for the first time is the minimum distance that must elapse between one device and another (progressive by type of road) so as to avoid their proliferation.
Speed cameras will not be allowed to be used where there is an excessively low speed limit: less than 50 km/h, on urban roads; for suburban roads only if the imposed speed limit is not reduced by more than 20 km/h compared to the speed limit set by the code for that type of road (if the limit is 110 km/h, the device can be used only if the limit is set at least 90 km/h but not for lower limits).
The decree specifies that the use of devices in a moving vehicle is allowed only if there is immediate challenge, otherwise fixed or mobile, duly visible locations must be chosen.
